California Health and Safety Code section 19851 provides that building plans can be inspected, but not copied without permission of the professional who signed the document and the original or current property owner. Furthermore, Federal copyright law [17 U.S.C. sections 101 and 102(A)(8)] provides that architectural plans can be inspected, but cannot be copied without the permission of the copyright owner. 

 

Accordingly, the plans you have requested may not be copied.

 

However, the plans will be made available for inspection at the Planning and Economic Development Department, 100 Santa Rosa Avenue, Room 3, Santa Rosa, CA 95404. Please make arrangements in advance, as the records may be in offsite storage, by calling (707) 543-3200 option 1 to inspect the records:

Monday/Tuesday/Thursday: 8 a.m. 

Wednesday: 10:30 a.m. – 4:30 p.m. 

Friday: 8 a.m. to noon

 

Signed owner/professional affidavits were not received and your request has been closed.  

Please feel free to resubmit your request for duplication of plans along with original fully executed owner affidavits to 100 Santa Rosa Avenue, Room 3, Santa Rosa, CA 95404.

Regarding your request for plans, please follow the affidavit process as described below. 

The property owner’s permission must be obtained before requesting permission from the design professional of record (architect/engineer).

The original building permit and or a picture of the design professional(s) seal as viewed on the construction documents have been provided to you. It is your responsibility to verify the design professional(s) current contact information which you can do by searching the Department of Consumer Affairs License Search here:  https://search.dca.ca.gov/

 

 

DIRECTIONS to Request Duplication of Construction Plans

(Examples of documents that require Affidavits: Construction plans, blue prints, architectural and engineer drawings, engineers’ calculations, soils reports, title 24, any document prepared by and or stamped by a licensed professional with a signature or seal.)

The property owner’s permission must be obtained before requesting permission from the design professional of record (architect/engineer).

 

Step 1.  The owner of the property must read and complete the Property Owner Affidavit form. The signature of the owner must be notarized or present, in person, valid identification and a copy of the Deed for the owner’s subject property must be provided. (*If the property has changed ownership within the last six (6) months, a Deed will be required to validate the property owner.)

Step 2. Make 2 copies of the completed Property Owner Affidavit.  Retain 1 copy for your records.  Mail 1 notarized copy to the Design Professional of Record by certified mail. Important: Retain the certified mail receipt as proof of mailing.

Step 3. The Professional of Record must provide their permission to duplicate the plans by reviewing the request and signing the affidavit. The Professional(s) of Record must return their affidavit to the City of Santa Rosa along with the notarized Owner’s Affidavit. If the Design Professional(s) do not respond to the request, after 30 days, bring the certified mail receipt to the Planning & Economic Development department for review; a determination will be made by the Chief Building Official.
